These terms govern the relationship between Kleinhans Digital and clients who engage our web design, digital marketing, and related services.
These Terms of Service constitute a legally binding agreement between LRWKleinhans (Pty) Ltd, trading as Kleinhans Digital, and any individual or entity that engages our services or uses our website. By submitting an enquiry, accepting a proposal, or making a payment, you agree to be bound by these Terms. They are governed by the laws of the Republic of South Africa.
Kleinhans Digital provides website design and development, SEO, branding and visual identity, digital marketing, e-commerce development, website maintenance, and Google My Business setup. The specific scope of any engagement is defined in a written proposal agreed upon before work commences.
A deposit of 50% is required before work commences and is non-refundable once work has begun. The remaining balance is due prior to final delivery. Invoices are payable within 7 days of issue. Late payments may be subject to interest at prime rate plus 2% per annum.
Upon receipt of full and final payment, ownership of the final website design, code, and graphic assets created specifically for your project transfers to you. We reserve the right to display completed work in our portfolio unless you request otherwise in writing prior to project commencement.
You agree to provide accurate and timely information, ensure all content and materials you supply do not infringe third-party intellectual property rights, respond to feedback requests within a reasonable timeframe, and honour payment terms as agreed.
Our total liability will not exceed the total amount paid by you for the relevant project. We are not liable for indirect or consequential losses including loss of revenue or profits. We do not guarantee specific search engine rankings, traffic levels, or conversion rates.
You may cancel a project at any time in writing. Work completed to the date of cancellation will be invoiced at our standard rate and the deposit is non-refundable. We may terminate an engagement if payment remains outstanding for more than 30 days.
Both parties agree to first attempt to resolve any dispute through direct negotiation within 14 days of written notice. These Terms are governed by the laws of the Republic of South Africa.
